British Columbia needs more skilled immigrants

A new government report says that the Canadian province, British Columbia, will need more skilled immigrants to fill skills shortages in the province. 

The Immigration Task Force (ITF) released their final report, confirming that British Columbia still needs more immigrants to fill skill shortages. The task force, appointed by Premier Christy Clark, was set up to review key government programs with the goal of increasing the number of skilled immigrants and investors in British Columbia.


Task force members held meetings and consultations with stakeholders across the province and came to the conclusion that if more skilled immigrants are not immediately brought into the province, businesses may have to close or relocate. This would result in fewer jobs and opportunities for people from British Columbia.

"Travelling across the province, hearing stories from a range of employers about the challenges they are facing filling jobs in all types of industries impressed upon the task force the immediate and overwhelming need to bring more skilled immigrants to B.C. through a more efficient and responsive system," said ITF Chair and Minister of State for Multiculturalism, John Yap.




The report mentioned 10 key recommendations for the province and the Canadian government. Some of the recommendations are as follows:

  • Immediately increase immigration levels for British Columbia
  • Grow and expand the British Columbia Provincial Nominee Program.
  • Ensure economic immigration program application processes and requirements are as straightforward and efficient as possible, and adjusting visa numbers accordingly to employer needs.
  • Capitalize on British Columbia as a destination of choice for entrepreneurs and investors.
  • Provide timely, effective information and support to newcomers and employers.

According to Pat Bell, Minister of Jobs, Tourism, and Innovation, British Columbia has already begun to take immediate action to fill job vacancies through the introduction of the Northeast Pilot Project. This will also expand the British Columbia Provincial Nominee Program to include more eligible occupations throughout the region.


"To sustain and create new jobs over the next decade we need more workers than British Columbia can supply. The recommendations in the ITF report point us in the right direction and give us the tools we need to achieve both our labour and economic goals. I'm proud that B.C. is taking this proactive approach to economic immigration," said Bell.

Language and employment biggest barriers for new Canadian immigrants

A new study has shown that the biggest concern for new immigrants and refugees settling in Ontario are finding employment and making sure that they have suitable language skills. Immigrants have difficulty finding work in Canada if they do not have adequate language skills.



The study, titled "Making Ontario Home", by the Ontario Council of Agencies Serving Immigrants (OCASI) uses research carried out over a period of two years analyzing newcomers' experience with use of immigrant services in the province. 




"This study shows that investment in settlement and integration services is making a real difference in the lives of immigrants," said Debbie Douglas, executive director of OCASI. "Investing in services at the front-end as soon as immigrants arrive, will have significant long-term benefits for immigrants and their families as well as Canadian society and the economy." 



Nearly two-thirds of the 2,530 respondents said employment was their highest concern, while immigrant and refugee-serving agencies were the main access point for employment service. According to the report, skills upgrading programs helped foreign trained professionals find jobs in the region. 

"Putting the skills of newcomers to work and improving their social and economic integration is key to Ontario's economic prosperity," said Charles Sousa, Ontario's minister of Citizenship and Immigration. "Ontario is committed to supporting these important immigrant services, which this study confirms remain a priority for newcomers." 

Other highlights from the report include:

  • Of the 83 percent who had used at least one settlement support service, 54.7 percent used language training programs, 50 percent used employment and skills training services;
  • 70 percent or more who had used language training programs rated them as "satisfactory" or "very satisfactory";
  • Transportation/distance was the most common barrier to accessing services;
  • Counselling and advice was the most-used general settlement service.

Canada to expand Alberta's Temporary Foreign Worker pilot project



Canadian immigration has announced they are expanding the Temporary Foreign Worker pilot project which allows Alberta employers to hire highly skilled foreign workers in certain in-demand occupations




"Alberta is facing some of the most acute labour shortages in the country," said Immigration Minister Jason Kenney. "The expansion of this pilot project will enable more employers in Alberta to hire foreign workers on a temporary basis to fill short-term skills and labour needs when Canadians or permanent residents are unavailable."

The pilot program was originally launched 1 June 2011 and allows eligible immigrants to come to Alberta to work temporarily in a specific occupation. This visa program issues them with a work permit that allows them to move freely between Alberta employers, without requiring authorization from Human Resources and Skills Development Canada/Service Canada.

Effective immediately, the following occupations are part of the Alberta Temporary Foreign Worker pilot program:

  • Steamfitter/Pipefitter
  • Welder
  • Heavy duty equipment mechanic
  • Ironworker
  • Millwright and industrial mechanic
  • Carpenter
  • Estimator

"Our consultations with Alberta employers and our own labour forecasts show there is a need to expand the pilot to include these high-demand occupations," said Alberta Minister of Enterprise and Advanced Education Stephen Khan. "We appreciate the cooperation and support of our federal colleagues in working with us to help employers get the workers they need sooner."

Canada to pause new applications for Federal Skilled Workers and Investors

From 1 July 2012, Citizenship and Immigration Canada (CIC) will place a temporary pause on new applications under the Federal Skilled Worker Program (FSWP) and federal Immigrant Investor Program. The temporary pause on FSWP applications does not apply to candidates with offers of arranged employment or those applying under the PhD eligibility stream. Normally you will need to have a positive labour market opinion from Human Resources and Skills Development Canada (HRSDC) for the arranged employment to be valid for the purposes of the Federal Skilled Worker Program.


Canadian Immigration Minister Jason Kenney explained that the pause on new applications is part of the department's ongoing reform of the country's economic immigration system.

"We have been making lots of changes to our economic immigration system," said Kenney. "We will take the next six months to do a lot of the heavy lifting to get us closer to a fast and flexible immigration system."

Kenney said that the pause on new applications will allow CIC to make important reforms to its economic immigration programs before accepting more applications. 

"This is an important step in moving towards a faster, more flexible immigration system, while immigration levels are at a historic high," said a CIC statement.

Since the launch of Canada's Economic Action Plan 2012, Kenney has announced a series of changes to CIC's economic immigration programs including:

  • eliminating the backlog of old Federal Skilled Worker Program applications;
  • improving the selection of Federal Skilled Workers;
  • creating a new Federal Skilled Trades Program;
  • modifying the Canadian Experience Class to help transition successful skilled temporary workers to permanent residence;
  • changing business immigration programs to target more active investment in Canadian growth companies and more innovative entrepreneurs; and
  • moving towards a new application management system, to develop a pool of skilled workers who arrive in Canada ready to begin employment.
"This temporary pause on new Federal Skilled Worker applications will allow us to set the program on a new course as we intend to launch revised selection criteria soon," said Kenney. "The pause has no impact on the number of workers Canada admits into the country, as CIC continues to process applications already received. We're not reducing the number of immigrants. We're just reducing the number of immigrants going into a queue."

CIC expects to begin accepting new Federal Skilled Worker applications again in January 2013, when the proposed FSWP regulatory changes are expected to be implemented. However the pause on new federal Immigrant Investor Program applications will remain in place until further notice.

In April, Kenney announced that CIC will be consulting with provinces, territories and stakeholders on ways to reform the current Immigrant Investor Program in order to maximize the economic benefit to Canada. The Department is also consulting on whether to create a new investor program on a short-term basis, to promote growth in the Canadian economy.

BILL C-35 NEW IMMIGRATION CONSULTANTS REGULATOR


Bill C-35, An Act to Amend the Immigration and Refugee Protection Act (formerly called the Cracking Down on Crooked Consultants Act) received Royal Assent on March 23, 2011 and is coming into force on June 30, 2011.
At its core, the Act amends the Immigration and Refugee Protection Act (IRPA), making it an offence for anyone other than an authorized representative to conduct business, for a fee or other consideration, at any stage of an application or proceeding. This includes the period before a proceeding begins or an application is submitted and means that anyone who provides paid immigration advice at the pre-application stage will need to be an authorized representative, as identified in section 91 of the Act.
Unpaid third parties, such as family members and friends, can still act on behalf of an applicant.
The Act also:
  • Includes the creation of a specific offence and doubles penalties from $50,000 to $100,000 and/or imprisonment for up to two years upon conviction by indictment; and from $10,000 to $20,000 and/or imprisonment for up to six months on summary conviction; 
  • Provides the Minister with the power, by regulation, to designate or revoke the designation of a body responsible for governing immigration consultants and to provide for transitional measures with respect to such a designation, or revocation of a designation; 
  • Authorizes the Governor in Council to make regulations requiring the designated body to provide the Minister with information regarding its activities. This information would be used to assist the Minister in evaluating: the effectiveness of the body in ensuring the integrity of the immigration program; whether the designated body is regulating its members in the public interest; and whether its members are providing their services in a professional and ethical manner; and
  • Includes a provision allowing the disclosure of information relating to the professional or ethical conduct of individuals to those responsible for governing or investigating that conduct.
While the Act will be in force as of June 30, 2011, regulations regarding information gathering and disclosure will be enacted at a later date.


Legislation cracking down on crooked immigration consultants will come into force on June 30, 2011, Citizenship, Immigration and Multiculturalism Minister Jason Kenney announced today.
A newly created Immigration Consultants of Canada Regulatory Council (ICCRC) was also announced at the media conference in Mississauga. “The Government of Canada has promised to crack down on crooked immigration consultants and their shady practices, and with Bill C-35, we now have the tools,” Minister Kenney said.
“Bill C-35 strengthens the rules governing those who charge their clients for immigration advice or representation, making it an offence for anyone other than an accredited immigration representative to conduct business, for a fee or other consideration, at any stage of an application or proceeding,” according to a press release. “It also increases penalties and fines for unauthorized representation and allows for more government oversight in order to improve the way in which immigration consultants are regulated.”
The federal ministry has also released a public service video to warn prospective immigrants and their relatives of fraudulent consultants in Cantonese, Mandarin, Punjabi, Tagalog and Urdu aside from English and French. 
With the designation of the ICCRC as the regulator of immigration consultants, those consultants who are currently members in good standing of the Canadian Society of Immigration Consultants (CSIC) can begin to register with the ICCRC on June 30, 2011.
Immigration representatives must be either members in good standing of a provincial or territorial law society, including paralegals; members of the Chambre des notaires du Québec; or members of the governing body for immigration consultants.
A 120-day transitional period will be put in place to ensure a smooth transition and continuity of service for both CSIC members currently in good standing and their clients during the transition to the ICCRC. The transition period will end on October 28, 2011.
After a notice was published on March 19, 2011, in the Canada Gazette, Part I, proposing the ICCRC be designated the regulator of immigration consultants, over 70 percent of the public comments received during the 30-day consultation period supported the proposal to establish a new regulator of immigration consultants.
“The ICCRC has committed to accountability, transparency and good governance and has pledged to work to protect the interests of consumers.” added Minister Kenney.
Key elements of Bill C-35
Changes to the Immigration and Refugee Protection Act (IRPA) require that all representatives used at any stage of an immigration application or proceeding be members in good standing of a provincial bar, the Chambre des notaires du Québec, or the governing body for immigration consultants, as designated by the Minister.
This makes it illegal for anyone to operate in Canada as an unauthorized representative at any stage of an immigration application or proceeding. This includes the period before a proceeding begins or an application is submitted and means that anyone who used to provide paid advice at the pre-application stage will need to be an authorized representative, as identified in section 91 of the Act.
The Minister of Citizenship, Immigration and Multiculturalism has been granted the authority to designate a body to govern immigration consultants. By virtue of his new authority under the Act, the Minister is enacting regulations designating the Immigration Consultants of Canada Regulatory Council (ICCRC) as the regulator of immigration consultants.
To enhance the Government’s oversight of the ICCRC, it will be required to provide information for the purpose of ensuring it governs its members in the public interest.
The Act also includes a provision allowing CIC, the Canada Border Services Agency and the Immigration and Refugee Board to disclose information relating to the professional or ethical conduct of individuals to those responsible for governing or investigating that conduct.
